11.3. Before specifying, purchasing, installing or otherwise relying on a product, the User is responsible for checking its current technical characteristics and suitability for the relevant project.

11.4. Users remain responsible for compliance with applicable laws, standards, design requirements and professional obligations.

11.5. SymetrIQ does not act as the designer, engineer, manufacturer, certifying body or technical supervisor of the User's project merely by providing access to the Portal or its content.

12. Intellectual Property

12.1. All intellectual property rights in the Portal, its software, user interface, database structure, technology, connectors, proprietary metadata structures, processing systems, documentation and SymetrIQ branding remain owned by SymetrIQ or its licensors.

13. Third-Party Software and Connectors

13.1. The Portal may interact with third-party products or services, including BIM and CAD applications.

13.2. Such third-party software is governed by the terms of its respective provider.

13.3. SymetrIQ does not control changes made by third-party software providers and cannot guarantee uninterrupted compatibility with every current or future software version.

13.4. References to third-party products or trademarks do not imply endorsement, partnership or affiliation unless expressly stated.

14. Usage Analytics

14.1. SymetrIQ may collect information about use of the Portal as described in the Privacy Notice.

14.2. This may include the products viewed, number of views, downloaded file formats and the country from which the Portal is accessed.

14.3. Manufacturers may receive aggregated analytics relating to their own portfolio, including product views, download activity, downloaded file formats and country-level statistics.

14.4. SymetrIQ does not provide manufacturers with a User's name, e-mail address or other directly identifying account information as part of standard manufacturer analytics unless the User has been separately informed and a valid legal basis exists.

15. Content Restrictions and Moderation

15.1. Content made available through the Portal must not infringe intellectual property rights, contain unlawful material, compromise system security or otherwise breach these Terms.

15.2. SymetrIQ may review reported content and may restrict access to, suspend, remove or disable content where SymetrIQ reasonably considers such action necessary because the content:

  1. (a) is unlawful;
  2. (b) infringes intellectual property rights;
  3. (c) presents a security risk;
  4. (d) contains materially misleading product information;
  5. (e) breaches these Terms; or
  6. (f) must be restricted pursuant to a legally binding order.

15.3. Content moderation decisions are ordinarily made through human review. SymetrIQ may use automated tools to identify technical, security or integrity issues but does not rely solely on automated decision-making for final legal-content determinations unless appropriate and lawful.

16. Reporting Illegal or Infringing Content

16.1. Any person may report allegedly illegal, infringing or materially incorrect content by e-mailing:

info@symetriq.org

  3. (c) the reason the reporting person considers the content unlawful or infringing;
  4. (d) sufficient supporting information; and
  5. (e) the reporting person's name and contact e-mail, except where applicable law permits anonymous reporting.

16.3. SymetrIQ will assess sufficiently substantiated notices in a timely manner.

16.4. SymetrIQ may contact the relevant manufacturer or rights holder as part of its assessment.

16.5. Where content is removed or restricted, SymetrIQ will provide an appropriate explanation to the affected party where required by applicable law.

16.6. The electronic point of contact for Users and for communications concerning Portal content is info@symetriq.org.

17. Availability and Maintenance

17.1. SymetrIQ uses commercially reasonable efforts to operate the Portal reliably and securely.

17.2. Unless a separate written agreement provides otherwise, SymetrIQ does not guarantee a specific uptime percentage.

17.3. Temporary interruption may occur because of maintenance, security measures, infrastructure failure, third-party service interruption, software deployment or events outside SymetrIQ's reasonable control.

18. Suspension and Termination of User Accounts

18.1. A User may request closure of their account by contacting SymetrIQ or using account functionality made available for that purpose.

18.2. SymetrIQ may suspend or terminate an account where the User materially breaches these Terms, unlawfully uses the Service, threatens the security of the Portal or repeatedly infringes third-party rights.

18.3. Where reasonably possible, SymetrIQ will provide notice and an opportunity to remedy the issue before permanent termination unless immediate action is required for legal or security reasons.

18.4. Termination of an account does not invalidate lawful project use of Digital Assets downloaded before termination, provided such continued use complies with Section 9.

19. Disclaimer of Warranties

19.1. To the extent permitted by applicable law, the Portal is provided on an “as available” basis.

19.2. SymetrIQ does not warrant that the Portal will always be uninterrupted or error-free or that every item of third-party Manufacturer Content will always be complete and current.

19.3. Nothing in this Section limits mandatory statutory rights.

20. Limitation of Liability

20.1. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

20.2. In relation to business Users, to the fullest extent permitted by law, SymetrIQ is not liable for indirect or consequential loss, loss of profit, loss of business opportunity or loss arising from reliance on inaccurate manufacturer-supplied information where SymetrIQ did not cause the inaccuracy.

20.3. SymetrIQ is not responsible for design decisions, engineering calculations or product-selection decisions made by Users.

20.4. Any limitation applying to a consumer shall apply only to the extent permitted under mandatory consumer-protection law.

21. Consumer Users

21.1. Individual consumers may use the Portal.

21.2. The standard User-facing Portal described by these Terms is currently provided without a subscription fee to Users.

21.3. These Terms do not affect mandatory consumer rights granted under Hungarian or other applicable European Union law.

21.4. If SymetrIQ later introduces a paid consumer service, the applicable purchase process and consumer information, including any statutory withdrawal or termination rights, will be provided before the User becomes bound by the paid service.

24.1. SymetrIQ may amend these Terms where reasonably necessary due to legal, technical, security or material service changes.

24.2. Material changes affecting registered Users will be communicated through the Portal or by e-mail before taking effect where reasonably practicable.

24.3. The current version and effective date will always be made available through the Portal.

25. Governing Law

25.1. These Terms are governed by Hungarian law.

25.2. For Users acting in the course of business, disputes shall be subject to the jurisdiction of the competent Hungarian courts unless otherwise agreed in writing.

25.3. For consumers, the choice of Hungarian law does not deprive the consumer of mandatory protections available under the law that would otherwise apply to them.

25.4. Consumer jurisdiction is determined by applicable mandatory law.

26. General

26.1. If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective.

26.2. Failure by SymetrIQ to enforce a provision on one occasion does not waive its right to enforce that provision later.

26.3. These Terms do not create an employment, agency, partnership or joint-venture relationship.

26.4. SymetrIQ may use subcontractors and technical service providers in providing the Portal.
